What a Protective Order Is
A protective order — sometimes called a restraining order or order of protection — is a court order that requires an abuser to stay away from you, your children, your home, your workplace, and your school. Ashley Boswell explains that the specifics vary by jurisdiction, but most orders can require the abuser to stop all contact, vacate a shared residence, and surrender firearms.
Common types include:
- •Emergency or Ex Parte Orders: Issued quickly, often without the abuser present, to provide immediate protection until a full hearing.
- •Temporary Orders: In effect for a short period, typically until the court holds a hearing with both parties.
- •Final or Permanent Orders: Issued after a hearing, lasting months or years depending on the jurisdiction.
How to Prepare
